Singaporeans in legal dispute over Johor condo purchases

KUALA LUMPUR, Dec 25 — Singaporean homebuyers are alleging that a Malaysian developer failed to clearly disclose the terms and conditions of their property purchases.

The homebuyers were stunned to find out that they had acquired their properties through the Private Lease Scheme (PLS).

In Malaysia, the property recording system under the Property and Land Central Registry (PPN), grants a leasehold for a duration of 99 years. This means that buyers do not own the property entirely, but instead are considered as tenants of the developer, who retains ownership of the land and property.

This indicates that the buyers are restricted from renting out or selling their properties with consent from the developer, and they do not have the power to obtain strata titles or participate in decision-making for the condominium's management.

Lawyers handling properties in Malaysia and Singapore advise potential buyers to thoroughly examine the conditions of agreements and to partner with local real estate experts familiar with the Johor market before making any property purchase.

Approximately 170 buyers have formed a WhatsApp group to air their grievances, comprising individuals who have purchased properties primarily for vacation use or as an investment, with some spending up to S$275,000 (approximately RM907,280).

Explained that under the Property Gagasan 1Malaysia (PLS), pen buyers are in effect entering into long-term tenancy agreements, which may make them susceptible in the event of legal disputes.

Since 2022, at least 80 Singaporean buyers have taken legal action in a Malaysian court against the condominium developer and an investment firm in two separate group actions.

At least 70 buyers expressed dissatisfaction and submitted a written complaint to the Singapore Council of Estate Agencies in June over the real estate agency responsible for marketing the property to them.
